2002.07.23: Report On Last Night’s Delegate Council

Subject: REPORT ON LAST NIGHT’S DELEGATE COUNCIL

Last night’s Delegate Council meeting received detailed reports concerning the status of Legal Aid’s city criminal contract, including: (1) Negotiations with the Bloomberg administration; (2) Counsel’s view of Union/Society litigation challenging the city’s conduct prior to, during and since the 1994 strike; and (3)
CAB/CDD staffing. Following these reports, the DC voted as follows on the substantive motions below.

Litigation

By a vote of 19-11-4, the DC adopted a motion submitted/2d by Mulligan and Affler (both of CDD–Manhattan) to table the following motion by Byrne and Diflumeri (both of CDD–Queens): Condition settlement (not dismissal) of the Union’s litigation concerning the 1994 strike on management’s written assurance that additional staff (other than replacement of attrition) will not be hired until after staff attorney compensation is increased by more than 2.5%/year.

By a vote of 19-12-2 (roll call below*), the DC adopted the following motion submitted/2d by Tom Bomba (CDD–Bronx) and Robert Zuss (CDD–Brooklyn): Authorize the ALAA Executive Board to decide settlement of the Union’s litigation concerning the 1994 strike, following negotiations with LAS
management over allocation of additional city funds. [Tomorrow, pursuant to this decision, the EB will meet with Management.]

CDD/CAB Staffing

By a vote of 19-2-3, the DC adopted the following motion submitted submitted/2d by Harpaz (CAB) and Ritter (CDD–Brooklyn): Oppose involuntary transfers from CAB to CDD, and delegate to ALAA’s CAB representatives the decision about whether the Union authorizes voluntary CAB buyouts.
